If you want to buy the source, do if you don't, don't.

There are plenty of people who get paid to modify these scripts for the bigger torrent sites.

Why not if you have done the work that others can't do, charge for it?

As for the theme it is just a graphical representation of what your site could look like, surely you wouldn't keep the same logo/design anyway so what's the problem?
